That's 'how' it should work but in My own experience it doesn't work like that very often.
There are countless tales online of cars being sold off to other people and the payout hasn't been completed yet

The owner ownes the car until the insurance company pay for it, they can then do what they like with it.

Be very careful here, check the cars current status on MID.
Most insurance policies have a clause about immediate termination of policy without refund if the car is classified as a total loss.
If you want the refund you have to add its value to the claim.
My concern here is that the vehicle remains on a public road, has physical damage and is now recorded as a MOT failure.
Tape up the damaged area to ensure there are no sharp edges.
From the sound of the negotiations it is possible that the Insurance company may believe the car is off road awaiting repair.
There is a posibility that they may already have removed the vehicle insurance listing from MID.
That removal would put you at risk of action from Police, VOSA check staff and the Local Authority parking gestapo.
It may be wise to tell the insurance company in writing that the car remains on the road in use while you arrange permanent repairs.
Pity the car was not at Portsmouth where I could perhaps have offered more direct help.
Can you list the MOT failure items please?
When does the previous MOT expire?

Had a call from the lying insurance company today saying they're going to pick up the car. A few days ago I was told I could keep the car. When mentioned to them the person on the other end just laughed and said no the decision is final and i'll get a call soon to arrange collection of the car. Cant even give the car away to someone who'll make good use of it anymore. Will almost certainly now end up as scrap which is a real shame.I'll try to remove a few bits off it before they grab it. Bit of a shit end to it all as I was thinking last night i'll repair it and get it back to how it was. really wishing I didnt even bother going through the insurance now as it was not worth it. The £600 they paid out will not buy another xm and probably won't even get a decent xantia anymore.

Have they offered you the opportunity to buy it back from them? I'm sure you can do this still.
It wouldn't take more than £600 to repair it using second hand panels. It would be a real shame to see it being cubed.

I'd strip it bare for that price! £600 only gets a rough xm with t&t these days
You need to get this all down and write to the insurance ombudsman showing the price of such a car as they won't get one in good kick for less than £1200 I'd say!

If you can, get it off the road.
Inform the insurance company, in writing, that you are referring the matter to the Ombudsman (don't bother with the ABI, they just look after their members!).
As you have presumably paid your premium until xyz date, tell them that you wish to keep it insured with them (not for road use), and that you are asking for all decisions about writing off, final payout, etc. to be put on hold.
Ask for all communications from them to be put in writing.
That's how I'd tackle it.
